The Rule: Rental income from separate property is separate in some states, marital in others. Your prenup must choose and state it clearly.

Clause 3: The Real Estate Clause for Your FHA House Hack

It must state:
The duplex at [123 Main St] purchased on for $250k with an FHA loan is the separate property of [Spouse A].[Date]
All mortgage paydown, appreciation, and cash flow from it remains separate property, even if marital funds are used for repairs.
If marital funds ARE used for capital improvements over $5k, how reimbursement works.

Without this, using a joint checking account to fix the roof can commingle the entire asset.

Clause 4: The Business Clause
Your LLC, S-Corp, Amazon Store, or property management company is not just property – it’s a business. This clause:
Defines the business as separate property
Waives any interest by the other spouse in the business value or future growth
Protects retained earnings inside the LLC

Clauses 5-9: The Financial Protection Clauses
5. Debt Clause: Your student loans, your business debt, and your mortgage before marriage stays yours. Debt taken out during marriage to improve your separate rental? Also yours.

  1. Retirement & Bank Accounts: Defines that 401k, IRA contributions and growth during marriage will be treated as [separate/marital – you choose].
  2. Spousal Support / Alimony Waiver or Limit: You can waive, cap, or set a formula. In many states, a full waiver is unenforceable if it leaves someone on public assistance, so we use a capped formula instead.
  3. Sunset Clause: Does your prenup expire after 10, 15, 20 years? For house hackers, we recommend NO sunset clause or a 20-year sunset. Otherwise you build a portfolio for 15 years and it all becomes marital on year 10.
  4. Estate Clause: A prenup should work with your will/trust. This clause states the prenup controls if someone dies, ensuring your rentals go to your kids or partners, not just your spouse.

Clauses 10-15: The Enforcement Clauses (Why Prenups Fail)
10. Full Financial Disclosure: The #1 reason prenups get thrown out.
11. Independent Counsel: Each person MUST have their own attorney. One attorney for both = automatic failure.
12. Severability Clause: If one clause is invalid in your state, the rest still stands.
13. Voluntary Execution Clause: States you were not pressured, threatened, or rushed.
14. Mediation / Arbitration Clause: Requires private mediation before court – keeps your financials out of public divorce records.
15. Governing Law Clause: States which state’s law applies (critical if you move from Ohio to Florida).

Statute Deep Dive: What Law Controls Your Prenup?

UPAA (Uniform Premarital Agreement Act): Adopted by 28 states. Allows almost anything except child custody/support.
