  অনুমান কাকে বলে? অনুমানের গুরুত্ব কতটুকু ? ত্রিশ বছরের পুরাতন দলিলের বিশুদ্ধতা সম্পর্কে অনুমান কি? বিভিন্ন প্রকার অনুমান অর্থাৎ অনুমান করতে পারে, অনুমান করবেন এবং চূড়ান্ত প্রমাণের ব্যাখ্যা।   অনুমান ( Presumption) কাকে বলে: সাক্ষ্য আইনের অনুমানের সুনির্দিষ্ট কোন সংজ্ঞা প্রদান করা হয়নি। তবে বিভিন্ন পর্যালোচনায় বলা যায়- প্রমাণ ছাড়া কোন বিষয় সাময়িকভাবে ধরে নেয়া হলে বা মেনে নেয়া হলে তাকে অনুমান (Presumption) বলে ।   অনুমানের গুরুত্ব: প্রমাণ ছাড়া কোন বিষয় সাময়িকভাবে ধরে নেয়া বা মেনে নেয়া হলো অনুমান। কিছু অনুমান খণ্ডনযোগ্য আবার কিছু অনুমান অখণ্ডনীয় হয়। যে অনুমানগুলি অখণ্ডনীয় সেগুলি সংশ্লিষ্ট বিষয়ের জন্য চূড়ান্ত প্রমাণ হিসেবে গণ্য হয়। আদালত অখণ্ডনীয় অনুমানের উপর ভিত্তি করে সিদ্ধান্ত গ্রহণ করতে পারেন। অন্যদিকে খণ্ডনযোগ্য অনুমান যদি সাক্ষ্য ছাড়া মিথ্যা প্রমাণ করা না যায় তাহলে এই ধরনের অনুমানের উপর ভিত্তি করেও সিদ্ধান্ত গ্রহণ করতে পারেন। সুতরাং বলা যায় অনুমানের যথেষ্ট গুরুত্ব রয়েছে। কারণ অনেক ক্ষেত্রে আদালত ন্যায় বিচার...

সরকারি দলিল বা সার্বজনীন দলিল ও বেসরকারি দলিল কাকে বলে?  একটি বেসরকারি দলিল কে প্রমাণ করতে পারে? এটি প্রমাণে সর্বোৎকৃষ্ট সাক্ষী কে?  কখন একটি দলিল পুরাতন হিসেবে গণ্য হয়? সরকারি দলিল ও বেসরকারি দলিলের পার্থক্য কি ?   সরকারি দলিল ( Public Docurients) বা সার্বজনীন দলিল কাকে বলে: সাক্ষ্য আইনের ৭৪ ধারা অনুযায়ী নিম্নের দলিলগুলি সরকারি দলিল : (১) সার্বভৌম কর্তৃপক্ষের কাজ : সার্বভৌম কর্তৃপক্ষের কাজের লিখিত বিবরণ, নথিপত্র, সংসদে প্রণীত আইন সরকারি দলিল হিসেবে গণ্য। (২) বিভিন্ন বিভাগের কাজ : বিচার বিভাগীয় বা শাসন বিভাগীয় কোন কর্মচারির কাজের লিখিত বিবরণ সরকারি দলিল হিসেবে গণ্য। (৩) বাংলাদেশ বা কমনওয়েলথের কাজ : বাংলাদেশ বা কমনওয়েলথের বিভিন্ন বিভাগের কাজের লিখিত বিবরণ সরকারি দলিল হিসেবে গণ্য। (৪) সরকারের নিকট রক্ষিত দলিল : সরকারের হেফাজতে রক্ষিত ব্যক্তিগত দলিলও সরকারি দলিল হিসেবে গণ্য। (৫) সরকারি সংস্থা ও ট্রাইব্যুনালের কাজ : সরকারি কোন সংস্থা ও ট্রাইব্যুনালের কাজের লিখিত বিবরণ সরকারি দলিল হিসেবে গণ্য। বেসরকারি দলিল কাকে বলে: সাক্ষ্য ...
