What is Documentary Evidence দালিলিক সাক্ষ্য কাকে বলে? মৌখিক ও দালিলিক বা দলিলভুক্ত সাক্ষ্যের পার্থকা কি? দলিলভুক্ত সাক্ষ্যের প্রমাণ সম্পর্কিত বিধিগুলি কি কি? সাক্ষীদেরকে দলিল দ্বারা অগ্রাহ্য করা যায় কিন্ত দলিলসমূহকে সাক্ষী দ্বারা অগ্রাহ্য করা যায় না-এর ব্যতিক্রম কি কি? কখন আদালত কতকগুলি দলিল সম্পর্কে বিশেষ ঘটনা অবশ্যই অনুমান করবেন? দালিলিক সাক্ষ্য (Documentary Evidence) কাকে বলে?  সাক্ষ্য আইনের ৩ ধারা অনুযায়ী-কোন মামলার বিচার্য বিষয় সম্পর্কিত যে কোন দলিল যদি আদালতে পরিদর্শনের জন্য উপস্থাপন করা হয় তাহলে তাকে দালিলিক সাক্ষ্য বলে। দালিলিক সাক্ষ্য একটি উৎকৃষ্ট সাক্ষ্য। দালিলিক সাক্ষ্য দ্বারা মামলার বিচার্য বিষয় প্রমাণ করা অথবা মিথ্যা প্রমাণ করা অত্যন্ত সহজ। মৌথিক ও দালিলিক বা দলিলভূক্ত সাক্ষ্যের পার্থক্য; নিম্নে মৌখিক ও দালিলিক বা দলিলভুক্ত সাক্ষ্যের পার্থক্য উল্লেখ করা হলা : পার্থক্যের বিষয় মৌখিক সাক্ষ্য ১। বিচার্য বিষয় সম্পর্কে আদালত  সাক্ষীকে যে সকল বিবৃতি প্রদান করার অনুমতি দেন তাকে মৌখিক সাক্ষ্য বলে।  ২। মৌখিক সাক্ষ্যকে ইংরেজিত...

 মৌখিক সাক্ষ্য কাকে বলেে? what is oral evidence?  “মৌখিক সাক্ষ্য সকল ক্ষেত্রে প্রত্যক্ষ হতে হবে”- এ দ্বারা কি বুঝায়? এর ব্যতিক্রম আছে কি? উৎকৃষ্ট সাক্ষ্য মতবাদ কাকে বলে? মৌখিক ও দালিলিক সাক্ষ্যের গ্রহণীয়তার উপর এই মতবাদের প্রভাব কি? মৌখিক সাক্ষ্য (Oral evidence) কাকে বলে:  সাক্ষ্য আইনের ৩ ধারা অনুযায়ী- মামলার বিচার্য বিষয় সম্পর্কে বা কোন মামলার প্রাসঙ্গিক বিষয় সম্পর্কে সাক্ষীকে আদালত যে বিবৃতি প্রদানের জন্য অনুমতি প্রদান করেন, সাক্ষী প্রদত্ত সেই বিবৃতিকে মৌখিক সাক্ষ্য বলে। অর্থাৎ সাক্ষীর সাক্ষ্য যখন মামলার বিচার্য বিষয় সম্পর্কিত হয় এবং আদালত কর্তৃক তা অনুমোদনপ্রাপ্ত হয় তখন তা মৌখিক সাক্ষ্য হিসেবে গৃহীত হয়। সাক্ষ্য আইনের ৫৯ ধারা অনুযায়ী- লিখিত বিষয়বস্তু ছাড়া অন্য সকল বিষয় মৌখিক সাক্ষ্য দ্বারা প্রমাণ করা যেতে পারে। মৌখিক সাক্ষ্য সকল ক্ষেত্রে প্রত্যক্ষ হতে হবে” অথবা মৌখিক সাক্ষ্যের সর্বোত্তম নিয়ম: সাক্ষ্য আইনের ৬০ ধারায় মৌখিক সাক্ষ্যের বিধান বর্ণিত হয়েছে। উক্ত ধারা অনুযায়ী- (১) দেখার বিষয় হলে নিজ চোখে দেখতে হবে : সাক্ষ্য যদি দেখা সংক্রান্ত কোন বিষয় হয়, ...
